Services for SMEs
We recognise that compliance issues can be bewildering, especially for small, young or growing companies.
For start-up companies, we can offer guidance and insight whether you are a sole trader, partnership, limited liability partnership of limited company. We can assist with incorporation and drafting key documents.
We can offer an out-sourced Company Secretary service for firms that find that they are large enough to require professional assistance but are not yet at a size where a permanent in-house role is achievable. We can attend Board meetings, prepare minutes, prepare Board packs and advise on Company law and procedure and ensure that relevant Companies House notices are correctly filed. Our fee is from £600 per Board meeting for a small company to include the transcription and provision of minutes and a Board pack.
If your firm is investigated by licensing authorities, trading standards or the police, we can provide expert representation at any interview under caution and help protect your position.
Should you face proceedings for any regulatory breach, we can provide expert representation before the relevant tribunal.
For licensing applications or employment law advice, we work closely with a number of specialist firms and can guide you to the best source of advice where appropriate.
Services for Commercial legal practices
Sometimes your corporate clients present with difficulties that require urgent assistance which is beyond your remit.
When you are called by the managing director of one of your lead clients because someone close to them is detained under arrest, you know that they are going to need the highest quality personal service available. Now is not the time to refer them to an overworked duty solicitor, struggling to operate on legal aid rates.
Our fixed fee for attending an interview under caution is £450 during office hours and £600 during non-business hours.
We can operate as your agent or swiftly accept a referral from you to take the problem off your hands. Should you wish to retain conduct of any future litigation, we will work hard to preserve the receipt of your instructions from your client.
For pre-arranged interviews under caution for your clients, we are happy to work as your agent or simply be a reliable source of expert representation which you can refer work to in confidence. Your clients will get the highest level of service that they are used to receiving.
We offer expert Magistrates Court advocacy services for all police, Crown Prosecution Service, British Transport Police, County Council, Local Authority, RSPCA, Health and Safety executive prosecutions and in relation to Licensing and Appeals. We deal with Appeals against DVLA decisions in relation to driving licences. We have a particular specialism with exceptional hardship applications and special reasons hearings and an enviable record in keeping drivers on the road. Our fee is £500 per hearing to include all relevant preparation work and pre-court conference if required.
Services for Criminal Legal Aid practices
Ensure that your private clients receive the quality of service that they deserve. Never offer a legal aid quality service at private client rates.
We do not have a criminal legal aid contract and do not feel that all clients can receive the level of service they expect or desire when operating within a tight fixed fee regime. Some clients simply need more time than you can offer them. Others are not financially eligible for legal aid and require a bespoke, expert service from an advocate at senior partner level.
If your practice thrives on the quick turn-around of volume work, it can be difficult to invest the time needed with private clients, and many criminal practitioners find motoring law work technical and challenging.
We can integrate with your operation, see your clients in your offices or at our consulting facilities in central Preston. We are happy to operate as your agent or for you to refer clients directly to us in the knowledge that we are not in competition with you.
We can provide representation for interviews under caution for private clients for a fixed fee of £450 during business hours or £600 during non-business hours.
For your private clients, we can provide expert advocacy in the Magistrates Court in the sum of £500 per hearing, to include all relevant preparation and a pre-court conference. We particularly welcome instructions for motoring law matters.
Until April 2020, we can perform your Court duty for you at Preston Magistrates Court, to include the obtaining of IDPC packs and reporting back to you within 24 hours with a detailed outcome report. We can liaise with your firm in relation to the date-stamping of any necessary legal aid applications. Full legal aid rates apply.
Whilst we are happy to accept agency instructions for legally aided trials, we regret that we are not in a position to offer police station representation at current legal aid rates.
We would be happy to accept referrals from you in conflict of interest cases in order that you do not need to refer clients directly to your closest business competitors.
Services for Car Clubs
With 8 years of experience working with one of the largest and most successful car clubs in the world, we are uniquely placed to offer advice and guidance to these complicated volunteer led organisations.
Rob Kellock has been actively involved with Porsche Club GB for 8 years, served as a Board member for 4 years, was Chairman from 2016 to 2018 and appointed Legal Advisor thereafter.
Car Clubs pose a unique set of challenges, often hampered by constitutions no longer fit for purpose and sometimes conflicts can arise between those who volunteer their time and those paid to administer the organisation. A vocal minority of members can cause serious challenges to those responsible for the organisation.
We can offer GDPR training, review your constitution and offer advice on your commercial contracts.
With strong trade contacts and commercial experience, as well as a keen motoring enthusiast, Rob is able to provide bespoke business advice for your organisation.
As protectors of your members’ subscriptions, you will be able to limit your Club’s exposure to legal costs by benefitting from our low overheads and obtain senior partner level advice for less than the price of a trainee solicitor from a large practice.
Services for Business
We are able to provide advice and representation in cases that proceed before the County Courts.
We can provide advice upon disputes with suppliers and disputes with customers.
Expert advocacy services are available on an agency basis to firms of solicitors or, directly to businesses. In addition, we can provide access to all specialist Barristers, not just those offering a Direct Access service.
Debt recovery work with intelligent enforcement advice is available. Let us review your outstanding debtors and guide you through the options available to you and risk assess the potential costs of enforcement.
We can provide expert advice for all breach of contract claims, whether you are alleged to be party to an alleged breach or wish to pursue a party which has failed to comply with your terms.
With our low overheads, it may well still be cost effective for your firm to seek expert representation without incurring big City charging rates.
We only accept instructions where we believe that we can add value and provide a cost benefit to you and will give straightforward advice on the merits of your case.
Expert Advocacy Services
Expert advocacy services are available on an agency basis to firms of solicitors or, directly to businesses.
Rob enjoys a renowned reputation as a Magistrates’ Court advocate with a thorough grasp of the law and an eye for detail. He has provided representation at thousands of Magistrates Court hearings.
Rob has been instructed by a number of leading local companies to protect the position of key team members at Court, notably in the area of motoring law where the loss of a driving licence can impact directly upon profitability. Defence representation has also been provided to companies facing allegations of breach of planning regulations, breach of license requirements and prosecutions by the Health and Safety executive.
Rob has defended cases of the utmost seriousness. By making direct contact with a specialist advocate with low overheads, your firm can save significantly on legal fees and avoid duplicating the provision of instructions (and payment) to both solicitor and Counsel where in-house advocacy skills are not available with your current commercial provider.
With over 25 years’ experience of practice in Lancashire, we have strong connections throughout the North West and beyond and offer access to specialist Barristers for Crown Court and Higher Courts work.
Representation at interviews under caution
Rob has been providing advice at interviews under caution since 1994. He has dealt with a number of major investigations and cases of the utmost seriousness.
Representation can be provided at short notice for businesses which find themselves under investigation by the police, Trading Standards, Health and Safety executive, British Transport Police, Local Authority and County Council investigations.
Whilst not all cases can be won at the investigation stage, many can easily be lost. When under investigation, it is vital to receive consistent, expert advice on your rights, options and the likely consequences of your decisions.
Advice is given from the perspective of a business owner who understands the potential commercial impacts upon you and your company.
If you have been asked to participate in an investigation or, even worse, if one of your team is under arrest, please ring now on 07767 471063 for instant advice.
Representation at Interview under caution starts from £450 during business hours and £600 during antisocial hours.
Services for Transport professionals
Appearing before the Traffic Commissioner can be a daunting experience.
Costs with some representatives can be exorbitant. Our low overheads mean that you can benefit from senior partner level advocacy at significantly reduced rates.
We provide a bespoke, personally tailored advice service and can provide sympathetic representation at public enquiries.
Whether you are a transport manager or owner, we can guide you through the regulatory maze and do our utmost to protect your livelihoods.
For public enquiries, there can be many variables in terms of the amount of preparation required and we will provide you with a formal quotation when we know the extent of the allegations you face and the likely volume of evidence we need to advise you upon.
As a full PCV licence holder for over 25 years, from 1990 to 2015, Rob has a unique insight into the issues faced by road transport professionals.
